In a landmark move, the California legislature in 2020 enacted a trio of bills significantly easing the path to creating accessory dwelling units (ADUs). These new state directives simplify procedures and minimize former local-level hurdles. Key highlights of the updated California ADU regulations include:
- Expedited Review Process: Local authorities in California are now mandated to approve or reject ADU applications within a 60-day timeframe following submission.
- Simplified Compliance Timeline: Homeowners can now bring non-compliant ADUs into compliance within a five-year period, streamlining what was previously a complex and protracted process.
- Defined Size Limits: The state has curtailed local control over setting ADU size limits, ensuring a minimum of 850 square feet for a single-bedroom ADU and 1,000 square feet for multi-bedroom units.\
- Diminished Yard Setbacks: The 2020 adjustments have reduced yard setbacks for ADUs to just 4 feet for both side and rear yards.
- Impact Fee Adjustments: For ADUs under 750 square feet, local jurisdictions can no longer impose impact fees. For larger ADUs, these fees must be proportionate to the ADU’s size relative to the primary residence.
- Flexibility in Garage Replacement: Under the new statutes, homeowners can replace, rather than just repair, a garage with an ADU of equivalent size.
- Limitations on HOA and CC&TR Restrictions: Homeowners Associations and property Covenants, Conditions, and Restrictions can no longer unduly obstruct ADU development.
